President Donald Trumpโ€™s administration is preparing to deploy Immigration and Customs Enforcement (ICE) agents near polling places as the Novemberโ€ฏ3,โ€ฏ2026 midterm elections draw near, according to multiple watchdog groups. The move comes amid a broader push by the White House to intensify deportations and crack down on undocumented residents during Trumpโ€™s second term. Federal officials have not confirmed any official plan, but the prospect of armed agents at voting sites has already sparked heated debate.

The push follows a rapid expansion of ICE under Trump. The agency now fields about 22,000 officers and agents, a 120โ€ฏpercent increase from the start of his second term. Recent spending packages have made ICE the bestโ€‘funded federal lawโ€‘enforcement body in the United States. Critics say the growth is tied to an aggressive immigration agenda that includes faster hiring and more raids, raising concerns about how the agency might be used in an election context.

Since Januaryโ€ฏ2025, ICE agents have been involved in at least 25 shootings, six of them fatal, and at least 60 detainees have died while in custody. Human Rights Watch and the ACLU warn that the agencyโ€™s presence could intimidate voters, especially in communities with large immigrant populations. A September poll by the University of California, San Diego found that 40โ€ฏpercent of respondents expected to see ICE agents near polling stations on election day. Federal law, dating back to 1865, bars armed federal officers from election sites unless a โ€œpeaceโ€‘keepingโ€ exception applies. Yet two incidents this year โ€“ one in San Antonio, Texas, and another in Ventura County, California โ€“ saw ICE agents conducting routine operations near polls before local police asked them to leave.

Advocates say the administration is testing the limits of the peaceโ€‘keeping loophole. Homeland Security Investigations, an ICE division, has reportedly been ordered to prioritize investigations of nonโ€‘citizen voting in the months leading up to the midterms. Legal experts warn that such directives could blur the line between law enforcement and voter intimidation. Civilโ€‘rights groups are preparing lawsuits and urging Congress to tighten the 1865 prohibition. How courts interpret the loophole could shape not only the 2026 elections but also future norms around federal agency involvement in the democratic process.
