The U.S. Supreme Court on Thursday upheld New Hampshireโ€™s top election officialโ€™s authority to refuse voterโ€‘identification cards that are student IDs, a move championed by the Republican National Committee as the state prepares for the 2024 midterm elections. The high courtโ€™s decision means the state can enforce a stricter interpretation of its 2022 voterโ€‘ID law, which limited the types of identification that can be used at the polls, and it effectively bars college students from presenting a universityโ€‘issued ID as proof of identity.

The ruling comes amid a nationwide surge in voterโ€‘ID legislation following the 2020 election, when many states tightened identification requirements amid claims of fraud. New Hampshireโ€™s 2022 law already narrowed acceptable IDs to driverโ€™s licenses, stateโ€‘issued nonโ€‘driver IDs, and a handful of other documents, but it left room for local officials to interpret the rules. The Republican National Committee sued the state in 2023, arguing that the law should be applied uniformly and that student IDs are too easy to obtain to serve as reliable proof. A federal district judge had previously ruled that the stateโ€™s election officials had overstepped by blocking student IDs beyond what the law explicitly prohibited, prompting the RNCโ€™s appeal to the Supreme Court.

Civilโ€‘rights groups and student organizations condemned the decision, warning that it could suppress turnout among younger voters who are less likely to have a driverโ€™s license. The New Hampshire Association of Student Governments called the ruling โ€œdiscriminatoryโ€ and announced plans to file a new lawsuit challenging the stateโ€™s implementation. The RNC praised the verdict as a victory for election integrity, saying it will help prevent โ€œfraudulent votesโ€ and ensure confidence in the electoral process.

State officials said they will issue updated guidance to municipal clerks within weeks, outlining the specific documents that will be accepted on Election Day. The decision also raises questions for other states with similar voterโ€‘ID debates, as courts watch how New Hampshireโ€™s stricter enforcement affects turnout and whether it prompts further legal challenges. With midterms only months away, the ruling adds another layer of uncertainty to an already contentious election season.
